{"id":1634,"date":"2016-02-01T17:33:37","date_gmt":"2016-02-01T23:33:37","guid":{"rendered":"https:\/\/reyesfenigeng.wordpress.com\/?p=493"},"modified":"2016-02-01T17:33:37","modified_gmt":"2016-02-01T23:33:37","slug":"drug-lord-trademark","status":"publish","type":"post","link":"https:\/\/reyesfenig.com\/en\/2016\/02\/01\/drug-lord-trademark\/","title":{"rendered":"The Drug Lord and the Trademark"},"content":{"rendered":"<p>The recent detention of the notorious criminal Joaqu\u00edn Guzm\u00e1n Loera, also known as \u201cel Chapo\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Guzm\u00e1n has called the attention of all Mexican media. The whole case is surrounded by hard to believe facts, some of them even surrealistic: the evasion from one of Mexico\u2019s top security jails using a mile long tunnel, Sean Penn\u2019s so called interview at one of the drugs kingpin\u2019s hideouts when he was still in the run, the bizarre relation of Guzm\u00e1n with the soap opera\u2019s actress Kate del Castillo and the possible extradition of the criminal to the USA are just a few of the topics around this event.<\/p>\n<p>One of the topics around Joaqu\u00edn \u201cChapo\u201d Guzm\u00e1n that has deserved a place in the recent news relates to trademarks. The press informed that there were attempts to register different versions of the name and nickname of Joaqu\u00edn Guzm\u00e1n Loera as a trademark. The applicants were Alejandrina Gisselle Guzm\u00e1n Salazar (marks \u201cJOAQU\u00cdN EL CHAPO GUZM\u00c1N\u201d and \u201cEL CHAPO GUZM\u00c1N\u201d), Emma Coronel Aispuro (mark \u201cJOAQU\u00cdN ARCHIVALDO GUZM\u00c1N LOERA EL CHAPO GUZM\u00c1N\u201d) and Mar\u00eda Alejandrina Salazar Hern\u00e1ndez (marks \u201cEL CHAPITO\u201d y \u201cEL CHAPITO GUZM\u00c1N\u201d).<\/p>\n<p>Mar\u00eda Alejandrina Salazar Hern\u00e1ndez (Mar\u00eda Salazar) was the Drug Lord\u2019s first wife<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>, Emma Coronel Aispuro (Emma Coronel) is the current wife of Guzm\u00e1n<a name=\"_ftnref2\"><\/a><a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> and some say that Alejandrina Gisselle Guzm\u00e1n (Alejandrina Guzm\u00e1n) is the daughter of Guzm\u00e1n Loera<a href=\"#_ftn4\" name=\"_ftnref4\"><sup><sup>[4]<\/sup><\/sup><\/a>.<\/p>\n<p>I do not know if any of the applicants were following Guzman\u2019s instructions, but it is important to highlight that no application was filed by Joaqu\u00edn Guzm\u00e1n Loera or on his behalf, as some media has incorrectly stated.<\/p>\n<p>On September 24, 2010 Alejandrina Guzm\u00e1n and Mar\u00eda Salzar filed trademark applications for different marks. Alejandrina Salzar applied for the registration of the marks \u201cEL CHAPO\u201d<strong>, \u201cJOAQU\u00cdN EL CHAPO GUZM\u00c1N\u201d and \u201cEL CHAPO GUZM\u00c1N\u201d and Mar\u00eda Salazar <\/strong>filed for the marks \u201cEL CHAPITO\u201d, \u201cEL CHAPITO GUZM\u00c1N\u201d and \u201cDON CHAPO GUZM\u00c1N\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Alejandrina Guzm\u00e1n\u2019s trademark applications for \u201cEL CHAPO GUZM\u00c1N\u201d covered products of International Classes 14 (jewelry and watches)<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>, 18 (articles made of fur, leather and leather imitation), 25 (clothing, footwear and headgear), 28 (toys and sports articles) and services of International Class 35 (advertising and business direction). The applications for \u201cEL CHAPO\u201d referred to goods and services of International Classes 14, 18, 28 and 35. The applications for \u201cJOAQU\u00cdN EL CHAPO GUZM\u00c1N\u201d were filed in International Classes 14, 18 and 25.<\/p>\n<p>Mar\u00eda Salazar filed applications for \u201cEL CHAPITO\u201d and \u201cEL CHAPITO GUZM\u00c1N\u201d in International Classes 14, 18, 25 and 35. She also filed an application for \u201cDON CHAPO GUZM\u00c1N\u201d in International Class 33 to identify alcoholic beverages except beer.<\/p>\n<p>On August 2011, the \u201cInstituto Mexicano de la Propiedad Industrial\u201d or Mexican Patent and Trademark Office (MPTO) issued the final refusal to all trademark applications that Mar\u00eda Salazar filed (\u201cEL CHAPITO\u201d, \u201cEL CHAPITO GUZM\u00c1N\u201d and \u201cDON CHAPO GUZM\u00c1N\u201d).<\/p>\n<p>As for the filings of Alejandrina Guzm\u00e1n, the MPTO approved the four applications for \u201cEL CHAPO\u201d (trademark registrations 1205096, 1205097, 120509 y 1219281) and rejected the applications for \u201cJOAQU\u00cdN EL CHAPO GUZM\u00c1N\u201d.<\/p>\n<p>The decisions regarding the rejections of the trademark applications for \u201cEL CHAPITO GUZM\u00c1N\u201d, \u201cDON CHAPO GUZM\u00c1N\u201d, \u201cJOAQU\u00cdN EL CHAPO GUZM\u00c1N\u201d and \u201cEL CHAPO GUZM\u00c1N\u201d basically state that the aforementioned marks are expressions used to identify an individual that, back then, was wanted by federal authorities in connection with several felonies, thus they were against morale and good uses and non-registrable, as provided by section 4 of the Industrial Property Law<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>.<\/p>\n<p>A few years later, on October 2014, Emma Coronel (current wife of Guzm\u00e1n) filed trademark applications in Classes 9, (electronics, software and computers), 16 (printed materials, stationary), 25 and 41 (education and entertaining) for \u201cJOAQU\u00cdN ARCHIVALDO GUZM\u00c1N LOERA EL CHAPO GUZM\u00c1N\u201d.<\/p>\n<p>On April 2015, the MPTO objected the trademark applications stating, on one hand, that the law prohibits registering the names or aliases of actual people without authorization; on the other hand, the examiner stated that the name of an individual that was being prosecuted could not be registered as a trademark because it was against moral and good uses. Emma Coronel did not answer the office actions and the applications became abandoned.<\/p>\n<p>I do not want to discuss here what are good uses and what is moral or immoral. Some conducts that may be immoral or unbearable for some people are completely justifiable for others. Even in the case of individuals that the State itself may consider as enemies, the conflict may have many different reasons and there can be disagreement about the morality of their actions, even inside the same community. Nevertheless, I think the decisions of the MPTO to reject the trademark applications for the name and pseudonyms of the leader of one of the largest criminal organizations in Mexico were reasonable. The trademark system is no intended to protect the name of a felon that is responsible, directly or indirectly, for the suffering, torture and death of thousands in Mexico, including several actual journalists.<\/p>\n<p>Then, why the MPTO issued to Alejandrina Guzm\u00e1n trademark registrations for \u201cEL CHAPO\u201d in four different classes of goods and services and at the same time rejected the trademark applications for \u201cEL CHAPITO\u201d filed by Mar\u00eda Salazar?<\/p>\n<p>As I stated before, in some regions of Mexico the word \u201cchapo\u201d is used to designate short people, without making any reference to illegal activities. I remember the skillful Mexican midfielder Luis Montes (currently playing for Leon in the Mexican First Division), who is called \u201cChapo\u201d or \u201cChapito\u201d, and his nickname has never been linked or construed as an evocation to Joaquin Guzm\u00e1n Loera.<\/p>\n<p>If \u201cchapo\u201d is a nickname without negative connotations widely used in Mexico, my guess is that the examiner thought he did not have solid grounds to state that \u201cchapo\u201d is a word intrinsically immoral or against good uses, so his only option was approving the registration of \u201cEL CHAPO\u201d filed by Guzm\u00e1n Salazar.<\/p>\n<p>Further, there are several trademark registrations owned by other people that involve the mark \u201cEL CHAPO\u201d to distinguish different goods and services.<\/p>\n<p>The MPTO issued several registrations for \u201cEL CHAPO DE SINALOA\u201d (translated as \u201cThe Chapo from Sinaloa\u201d) in the name of Ernesto P\u00e9rez Zagaste. Apparently, Mr. P\u00e9rez is a singer of one kind of Mexican folk music called \u201cbanda\u201d that uses \u201c<a href=\"http:\/\/elchapooficial.com\/\">EL CHAPO DE SINALOA<\/a>\u201d as artistic name.<\/p>\n<p>Mr. P\u00e9rez claims in his website that he was born at the county of Badiraguato, in the Mexican state of Sinaloa; the Drug Lord Joaquin \u201cChapo\u201d Guzm\u00e1n is also from Badiraguato, Sinaloa.<\/p>\n<p>Mr. Ernesto P\u00e9rez also owns Mexican trademark registrations numbers 1,116,647 and 1,131,017 for the mark \u201cEL CHAPO\u201d. The MPTO issued the registrations in 2009 to identify Class 09 goods (cds, dvs, software, lenses and computer equipment are classified in Class 09) and Class 41 services.<\/p>\n<p>Another individual, Mar\u00eda de los \u00c1ngeles Moreno Rodr\u00edguez registered the trademark \u201cEL CHAPO\u201d to identify clothing, shoeware and headgear (trademark registration number 948,388) since August 2006. Ms. Rodriguez filed a trademark application (serial 796,602) on July 2006 for the mark \u201cLOS ZETAS\u201d also in Class 25. \u201cLos Zetas\u201d is the name of one of the most violent criminal organizations in Mexico. The examiner objected the application for \u201cLOS ZETAS\u201d on grounds of the statutory prohibition provided in section 4 of the Industrial Property Law, the applicant did not answer and the application became abandoned.<\/p>\n<p>The MPTO did not refuse the applications for \u201cEL CHAPITO\u201d that Ms. Maria Salazar filed, on grounds of defense of morality or good uses. The reason was that \u201cEL CHAPITO\u201d was confusingly similar the earlier filed trademark \u201cEL CHAPO\u201d by Alejandrina Guzm\u00e1n to cover the same products and services in Classes 14, 18, 28 and 35 and confusingly similar to the senior trademark registration of Ms. Moreno \u201cEL CHAPO\u201d in Class 25.<\/p>\n<p>I do not know why Mar\u00eda Salazar filed for \u201cEL CHAPITO\u201d and Alejandrina Guzm\u00e1n for \u201cEL CHAPO\u201d, but the fact was that Alejandrina Guzman filed first (just for a few minutes, but first), thus her applications anticipated the trademark applications for \u201cEL CHAPITO\u201d and were the cause of the rejections. If the applications for \u201cEL CHAPITO\u201d and \u201cEL CHAPO\u201d would have been filed in the name of the same person, the chances of obtaining the registrations for \u201cEL CHAPITO\u201d would have been better, at least in Classes 14, 18, 28 and 35.<\/p>\n<p>Meanwhile, a collateral victim of all the noise around the trademarks of \u201cEl Chapo\u201d could be Luis \u201cel Chapo\u201d Montes who, in order to avoid misunderstandings or inconvenient associations, could ask the fans and the press to stop using the nickname \u201cChapo\u201d or \u201cChapito\u201d when speaking or writing about him. Would he like to be called Luis \u201cShorty\u201d Montes?<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> One of the most important and authoritative dictionaries in the Spanish-speaking world is the one that the Real Academia Espa\u00f1ola (based in Spain) publishes. The dictionary of the Real Academia defines \u201cchapo\u201d as \u201csubstantive male and female, colloquial in Mexico. Person of short height\u201d.
